Coins Agreement Policy
The service offered by Cheeka includes the purchase of digital coins and gifts, which are elements of the user interface (images and buttons) that Members can interact with. Coins can be used to send gifts to other members as a way of showing appreciation, expressing interest, or gaining their attention.
As digital assets, coins and gifts are the intellectual property of Cheeka, distributed under license to enhance the user experience (the “Licensed Content”). Cheeka is the sole owner of this intellectual property and retains all related rights.
1. License to Use Coins
By purchasing coins, the Member acquires a limited, revocable, non-transferable, and non-sublicensable worldwide license to use the coins as part of the Service. The coins can be used to interact with the user interface’s unique elements (e.g., "gifts" buttons) and to communicate more effectively with other Members. Any other use of Licensed Content is strictly prohibited.
2. Nature of Licensed Content
Coins are displayed as small images in the user interface of the Service, while gifts are displayed as buttons that allow Members to interact with others. When a "gift" button is pressed, the recipient can see the gift and may take notice of it, potentially leading to a conversation with the sender.
However, the Licensed Content holds no real-world monetary value and is not considered currency or property of any kind. Coins cannot be exchanged, sold, or transferred to any third party, including other users or Members, nor can they be used outside the Cheeka Service. They cannot be exchanged for cash, goods, services, or anything else of value. Neither Members nor users have ownership or any monetary interest in the Licensed Content, which remains the sole intellectual property of Cheeka.
3. No Refunds or Exchange for Value
Due to the digital nature of the Licensed Content, no refunds will be provided. Once purchased, the Licensed Content is consumed immediately and displayed through the Service. The Licensed Content cannot be traded, sold, bartered, or otherwise transferred for any form of compensation, whether monetary or otherwise, inside or outside the Cheeka Service. Any such transactions are void and will not be recognized by Cheeka or its users.
4. Cheeka's Rights to Modify or Terminate
Cheeka reserves the right to modify the Licensed Content at its sole discretion. These modifications may affect its rarity, desirability, effectiveness, or functionality. Cheeka may also revoke or terminate a Member’s license to use the Licensed Content, or restrict its use, at any time, for any reason, without prior notice or liability.
5. Prohibited Activities
You are prohibited from engaging in or soliciting any of the following activities related to the Licensed Content:
• The exchange of Licensed Content for money, donations, or any other form of value.
• Requests for money, donations, or any other form of value in exchange for the Licensed Content.
• Offering or requesting items, services, or favors with any monetary value in exchange for the Licensed Content.
Any attempt to engage in these activities will be considered a violation of this policy and will result in immediate action, including but not limited to account termination or restriction of service.
6. No Real-World Value
For the avoidance of doubt, the Licensed Content does not have any real-world currency equivalent and cannot be exchanged for real currency or anything of real-world value. Neither Cheeka nor any other entity is obligated to exchange the Licensed Content for anything of value.
7. Google Virtual Goods Policy Addendum
As part of compliance with Google’s Virtual Goods Policy, all coins and gifts within the Cheeka Service are purely for virtual use within the platform. They are intended solely for enhancing the user’s experience on the platform and cannot be redeemed or exchanged for real-world currency or tangible goods.
Any attempt to offer, trade, or exchange virtual goods for real-world value, including services or physical items, will be strictly prohibited. This aligns with Google’s policy to ensure that virtual goods remain non-transferable, non-refundable, and not used for external financial transactions.
